The UK Information Commissioner's Office (ICO) has issued an enforcement notice against Koypo Laboratories Limited for sending over 2 million unsolicited direct marketing e-mails to subscribers between 1 March 2017 and 31 March 2018 without their consent. The ICO stated that that the acts of Koypo Laboratories contravened regulation 22 of the the Privacy and Electronic Communications (EC Directive) Regulations 2003 (PERC), which prohibits persons from transmitting unsolicited communications for the purpose of direct marketing by electronic mail unless the recipient has previously notified the sender of consent. The action which was instituted as a measure to protect consumers in electronic transactions also provided the means and conditions under which Koypo Laboratories could appeal against the decision.
