According to the International Association of Privacy Professionals (IAPP), The Croatian Presidency of the Council of the European Union submitted a progress report on the latest draft ePrivacy Regulation. The most important modification introduced by the presidency is the possibility to process electronic communications metadata (article 6b), to use processing and storage capabilities of terminal equipment, and the collection of information from end-user terminal (article 8) when it is necessary for the purpose of legitimate interests. In order to provide a balanced solution, the presidency has also proposed a number of safeguards. The new draft includes the possibility of relying on legitimate interest to process electronic communication metadata and to place cookies and other trackers on end-user terminals. The presidency noted in the progress report, that the introduction of the legitimate interest' grounds in the ePrivacy Regulation elicited 'mixed reactions' from EU member states.
