The Brazilian Supreme Federal Court has denied the right to be forgotten in Brazil, stating that the creation of this right would jeopardise freedom of expression and is against the Brazilian constitution.
The case in question relates to the extraordinary appeal in Globo Comunica??es e Participa??es S/A v. Nelson Curi et al., where the family of Aida Curi, who was murdered in 1958, sought the application of the right to be forgotten as well as damages against TV Globo. The television station aired a program episode reconstructing the crime without authorisation from the victim's family.
